Zoning

The Board of Zoning and Building Appeals (BZA) does not have regularly scheduled
meetings; meetings are scheduled when variance requests are filed.
Meetings are usually scheduled at 7:00 pm and held in the Council Chambers of the
Municipal Building, 25 N. Second St.
As soon as a request is filed, BZA members are contacted to identify a date, far enough in
advance to allow for distribution of required notices, when at least three members are
available. The meeting date will be three to four weeks in the future. Depending on the
nature of the project, approvals by the Historic District Commission and Planning
Commission, and Municipal Council may also be required. Each review process has
public notification requirements resulting in additional lead times.

PERMITS: A zoning permit is required. Chapter 1147.03 (a) of the Building and
Zoning Code states: “…Before proceeding with the erection, relocation, or alteration of
any building or any part of a building in the City, a permit for such erection, relocation,
or alteration shall be first obtained from the Municipal Administrator by the owner or his
agent…No person shall proceed with the erection, relocation or alteration of any building
unless such permit shall have first been obtained.”
For a zoning permit, it is necessary to supply a dimensioned drawing of the shed showing
the planned shed location, dimensions to other buildings, location relative to property
lines and lot dimensions. Shed must be in the backyard and at least 5 feet from all
property lines.
Contact Lucas County Building Regulations, 419-213-2990 for building permit
information. It will be necessary to advise them of the building size at the time of a call.
Issuance of a Zoning Permit requires from three to five days unless there are unusual
circumstances.
Zoning Permit application forms are available at the Municipal Office Building, 25 North
Second St. during normal office hours.

a) Scope. This Section shall apply to all swimming pools, spas, ponds and water gardens within the
Municipality.
b) Definitions. As used in this section:
(1) “Limited Access Ladder” means any ladder with provision for making entry inaccessible when the
pool is not in use, such as swing-up or slide-up.
(2) “Pond” means any exterior artificial or non-natural excavation, grading or enclosure containing or
normally capable of containing water at a depth at any point greater than two-feet.
(3) “Portable ladder” means any ladder, which by its portable nature, is intended to be physically
removed with ease when the pool is not in use.
(4) “Private Swimming Pool” means any indoor or outdoor structure, chamber or tank containing a
body of water for swimming, diving, or bathing located at a dwelling house of no more than three
families and used exclusively by the residents and their nonpaying guests.
(5) “Public Swimming Pool” means any indoor or outdoor structure, chamber or tank containing a
body of water for swimming, diving or bathing that is intended to be used collectively for
swimming, diving or bathing, and is operated by any person whether as the owner, lessee,
operator, licensee or concessionaire, regardless of whether or not a fee is charged for use, but does
not mean any public bathing area or private swimming pool.
(6) “Public Bathing Area” means an impounding reservoir, basin, lake, pond, creek, river or other
similar natural body of water.
(7) “Water Garden” means a pool of water with or without a liner, with a surface area of 100 square
feet or less and with a depth of three-feet or less used as a landscape feature with aquatic plants
and with or without ornamental fish.
(c) Permit Required. Before work is commenced on the construction of any pond or outdoor public or private
swimming pool or any addition, remodeling, or other improvement thereto, a permit shall be obtained in accordance
with Section 1147.03 of this Planning and Zoning Code.
(d) Exemptions.
(1) All inflatable pools, kiddy pools, or those otherwise temporary in nature and which are seasonally
erected after May 1 of each year and dismantled before September 15 of each year and not exceeding
eighteen (18) inches in depth and/or a surface area of 115 square feet or less are exempt from the
provisions of this Section.
(2) All hot tubs, home spas and whirlpool tubs with a surface area of 150 square feet or less and with a
safety cover meeting the requirements of ASTM Standard F 1346, Standard Performance Specification
for Safety Covers and Labeling Requirements for All Covers for Swimming Pools, Spas and Hot Tubs
are exempt from the provisions of this Section.
(3) All water gardens are exempt from the provisions of this Section.
(e) Ponds.
(1) Ponds are permitted in any Zoning District as an accessory use with the following conditions:
A. The pond is incidental to a primary use as set forth in the Planning and Zoning Code.
B. A site plan including location, setbacks, depth and side slope, as well as any fencing or marking
shall be submitted with the application for such permit.

C. Ponds with surface areas in excess of 800 square feet shall have front, side and rear yard
setbacks of not less than ten percent (10%) of the width of the lot where the pond is located, or
the yard setbacks specified elsewhere in this Planning and Zoning Code, whichever are greater.
No pond shall be nearer than five feet to any lot line.
D. The edge of the normal water surface of a pond shall not be closer than fifty-feet to any septic
system, well or leach field.
(f) Barrier Requirements.
(1) Every outdoor swimming pool shall be completely surrounded by a barrier which shall comply with the
following:
A. The top of the barrier shall be not less than six (6) feet above grade for public swimming pools
and not less than four (4) feet above grade for private swimming pools, measured on the side of
the barrier that faces away from the pool. The maximum vertical clearance between grade and
the bottom of the barrier shall be 2 inches measured on the side of the barrier that faces away
from the swimming pool. Where the top of the pool structure is above grade, such as an
aboveground pool, the barrier may be at ground level, such as the pool structure, or mounted on
top of the pool structure. Where the barrier is mounted on the top of the pool structure, the
maximum vertical clearance between the top of the pool structure and the bottom of the barrier
shall be 4 inches.
B. Openings in the barrier shall not allow passage of a 4-inch diameter sphere.
C. Solid barriers which do not have openings, such as a masonry or stone wall, shall not contain
indentations or protrusions except for normal construction tolerances and tooled masonry
joints.
D. Where the barrier is composed of horizontal and vertical members, it shall be constructed so
that the horizontal members are on the pool side of the barrier. Spacing between vertical
members shall not exceed 1-3/4 inches in width. Where there are decorative cutouts within
vertical members, spacing within the cutouts shall not exceed 1-3/4 inches in width.
E. Maximum mesh size for chain link fences shall be a 2-1/4 inch square unless the fence is
provided with slats fastened at the top or the bottom which reduce the openings to not more
than 1-3/4 inches.
F. Access gates shall comply with the requirements of Section 1145.13(f) (1) A. through E., and
shall be equipped to accommodate a locking device. Such access gates shall be kept locked
when the pool is not in actual use or is left unattended.
G. A building or existing wall may be used as part of such enclosure if the intent of providing a
minimum six-foot or four foot high pool access barrier is met.
H. No person in possession of land within the Municipality either as owner, purchaser, lessee,
tenant, or licensee on which is situated a swimming pool shall fail to provide or maintain such a
barrier as herein provided.
(2) Where an aboveground pool structure is used as a barrier or where the barrier is mounted on top of the
pool structure, and the means of access is a ladder or steps, then the following conditions must also be
met:
A. When not in use, a pool with a portable ladder shall be rendered inaccessible by removing such
ladder from the pool.
B. When not in use, a pool with a limited access ladder shall be rendered inaccessible by placing
such ladder in a position that prohibits entry to the pool.

C. As an alternative to A. and B. above, the ladder or steps shall be surrounded by a barrier which
meets the requirements of 1145.13(f) (1) A. through H.
(3) Barriers shall be located so as to prohibit permanent structures, equipment or similar objects from being
used to climb the barriers.
(4) All hot tubs, home spas and whirlpool tubs with a safety cover meeting the requirements of ASTM
Standard F 1346, Standard Performance Specification for Safety Covers and Labeling Requirements for
All Covers for Swimming Pools, Spas and Hot Tubs are exempt from the barrier requirements.
(g) Lighting; Noise.

Parks

This procedure outlines the criteria for messages and the process for organizations to submit
requests and schedule messages to be displayed on the Pray Park electronic message sign located
on the corner of the Anthony Wayne Trail and Farnsworth Road.
1. City of Waterville messages will have priority over all outside requests.
2. Messages are strictly limited to educational, charitable or public service activities related
to community non-profit organizations serving the City of Waterville. Messages related
to political issues, candidates for elective office or commercial advertising are not
permitted. Other prohibited messages include those that are personal (Happy Birthday,
Happy Anniversary, etc), illegal, sexually explicit, offensive or obscene, or those that
violate equal opportunity, anti-discrimination or harassment laws. The City reserves the
right to reject a message with inappropriate content, at the sole determination of the City.
3. External message requests must be submitted on an Electronic Sign Request Form a
minimum of five (5) business days prior to the requested posting date. Forms are
available at www.waterville.org or at the front desk of the Municipal Building. The
request form must be completed legibly and in its entirety to be considered. No phone or
e-mail requests will be accepted.
4. External messages will remain on the sign no longer than seven (7) consecutive calendar
days and will be posted no earlier than three (3) weeks prior to the event.
5. The City of Waterville does not guarantee that any particular message will be placed on
the sign.
6. The City reserves the right to limit the number of messages displayed in the message
rotation on the sign to allow sufficient display of messages to passers-by. Message
requests will be considered on a first-come, first-served basis in applying this limit.
7. The City of Waterville reserves the right to alter the text of a message as needed to fit the
electronic message sign.
8. Each message will appear on the sign for approximately 8-10 seconds. Messages appear
on both sides of the sign simultaneously.
9. No more than one message per event or per group will be displayed at the same time.

The City of Waterville has adopted the following regulations governing the use of the Conrad Park
Recreation Building. Please note that the building is NOT air conditioned.
These regulations are not designed to discourage the use of the building or to lessen the pleasure of
those using it, but rather to insure that all users will find it a pleasant building and will not be denied full
enjoyment because of a few careless and thoughtless individuals.
I. RESERVATIONS
a. Reservations can be made Monday through Friday between the hours of 8:00 a.m. and 4:30
p.m. excluding holidays at the Municipal Building, 25 N. Second St.
b. Forms are provided ( www.waterville.org) for making reservations and must be completed
and signed by the person in charge of and responsible for the group using the building.
c. Reservations are accepted one year in advance by the month. As an example, if you would
like to reserve the building for a date in July 2019, you could make a reservation anytime
after July 1, 2018.
d. Building rental to groups primarily involving minors is restricted to non-profit organizations
only. A list of the names of adult chaperones must accompany the application with a ratio of
at least one (1) adult per fifteen (15) minors.
II. RENTAL FEES
a. All individuals/groups using the building shall pay a rental fee and a deposit in accordance
with the following.

b. All rental fees must be paid at the time of application in order to hold the reservation (no
exceptions). Cancellations prior to the desired date shall result in forfeiture of the
entire rental fee.
c. The deposit must be paid 30 days prior to the reservation date. If the deposit is not paid, the
rental fee shall be forfeited and the reservation cancelled.
III. HOURS OF OPERATION
The Conrad Park Recreation Building will be available for rental daily between the hours
of 8:00 a.m. and 1:00 a.m.(defined as a “day” for the purpose of building rental). Set up
and take down/clean up time is included within the specified rental hours. If additional
time is needed for set up, such as the night before an event, the building must be rented
for both days.

IV. DEPOSIT TO GUARANTEE CONDITION OF BUILDING.
The specified security deposit shall be required of every group using the building to cover
the cost of key replacement/locksmith charges, damages and/or excessive cleaning. The
deposit must be made at least 30 days prior to the rental Monday through Friday between
the hours of 8:00 a.m. and 4:30 p.m. excluding holidays at the Municipal Building, 25 N.
Second St. The deposit will be refunded when the key is returned and a full inspection
reveals that the building was left in good condition. If the building is not left in good
condition, then the group using the building shall be liable for all necessary expenses and
shall be denied further use of the facilities until the claim is satisfied. City community
groups making regular use of the facilities may make a written request to have the
deposit waived. Such a waiver shall be at the sole discretion of the City and may be
revoked at any time. Waiver of the deposit shall NOT waive any of the requirements
specified in these regulations.
V. KEYS
The key to the Conrad Park Recreation Building must be picked up at the Municipal
Building before 4:30 p.m. the day prior to the rental. If the rental falls on a Sunday or a
Monday, the key may be picked up on Friday before 4:30 p.m. Possession of the key
does not give a group permission to use the building prior to 8:00 a.m. on the day of their
rental. A forfeiture of $25.00 of the deposit will result if the key has to be provided
by City personnel after regular business hours. It is the responsibility of the group
using the building to lock all doors and windows when leaving the building. Failure to do
so may result in loss of building privileges. The key must be returned to the Municipal
Building the day after use of the building, unless renting on Friday, Saturday or the day
before a holiday, in which case it shall be returned the morning of the next business day.
NO ONE will be permitted to retain a key, even though they may have quarterly
reservations.
VI. CLEAN UP
Each group using the building is required to perform a reasonable clean up before
leaving. Minimum clean up shall consist of:
a. Removal of all food and beverages from premises.
b. Picking up and placing of all trash and debris in containers located in the kitchen area
provided for this purpose. (Trash bags are provided and can be found in the furnace
room)
c. Cleaning up of any liquids or foods, which may have been spilled on floors, counters,
etc.
d. Floors should be swept and free of debris.
e. General cleaning of the entire building including the kitchen and restrooms.
VII. FOOD AND BEVERAGES
a. Food and beverages may be served in the building. Users are asked to leave the
food facilities as clean as they found them.
b. No alcoholic beverages shall be permitted on any City owned property unless the
Municipal Administrator has approved an “Application for Alcoholic Beverage Permit”
prior to the scheduled function. If a permit for alcohol is granted, all persons drinking
an alcoholic beverage shall remain in the building while drinking.
c. You must be a resident of the City to apply for an “Application for Alcoholic Beverage
Permit.” An additional $150.00 deposit is required along with a fee of $50.00. The
deposit will be refunded after inspection of the premises. The deposit will not be
refunded if the public area used is left in a condition that necessitates cleanup or
repair.

VIII. BUILDING INSPECTION
The building will be inspected by City personnel on the morning of the next regular
workday after use. Please note the condition of the building when you enter, and if any
unusual condition or maintenance issue is evident, please note and notify the City
immediately by calling (419) 878-8100 Monday – Friday (except holidays), 8:00 a.m. to
4:30 p.m. If after regular business hours or on holidays, please call the Waterville Police
Department at (419) 878-6666; otherwise, your group will be held responsible.
IX. CONDUCT
a. Any conduct that infringes upon the rights of others, is potentially harmful to the
facilities, is illegal, or is otherwise not in good taste, will not be tolerated.
b. Commercial or profit-making activities are not allowed including charging admission
fees or selling products or services. If there are questions as to whether a group’s
planned activities will comply with this regulation, the City shall be consulted at the
time the reservation is made. The City of Waterville shall be the sole judge of
whether an activity meets this requirement.
c. No motor vehicles are permitted in the building without the prior written approval of
the Municipal Administrator.
d. Failure to abide by these rules of conduct will be grounds for causing the building to
be vacated and future use to be denied. Anyone using the parks or any building in
the City shall at all times comply with the ordinances of the City.
e. The premises are under camera surveillance.
X. DECORATIONS
Decorations may be placed in the Conrad Park Recreation Building subject to the
following provisions:

The shelters and gazebo were built for the enjoyment of City residents of ALL ages, and their
guests, and these regulations are not designed to discourage their use or to lessen the pleasure
of those using them, but rather, to insure that all will find the shelters & gazebo pleasant and
will not be denied full enjoyment because of a few careless and thoughtless individuals:
I. RESERVATIONS
a. Reservations can be made Monday through Friday between the hours of 8:00 a.m.
and 4:30 p.m. at the Municipal Building, 25 N. Second St.
b. Reservations are accepted one year in advance by the month. As an example, if you
would like to reserve a shelter for a date in July 2011, you could make a reservation
anytime after July 1, 2010.
c. Forms are provided for making reservations and must be completed and signed by the
person in charge of and responsible for the group using the building.
II. RENTAL FEES

a. All groups using the shelters or gazebo shall pay, in addition to the required deposit,
a rental fee in accordance with the following.

IV. DEPOSIT TO GUARANTEE CONDITION OF SHELTER.

A security deposit in the amount of $25.00 shall be required of every group using a
shelter or the gazebo, to cover the cost of damage and/or excessive cleaning. Said
deposit is due and must be paid at the Municipal Building before 4:30 p.m. the day prior
to the event. If the event falls on a Sunday, then the deposit must be paid on Friday
before 4:30 p.m. Failure to make the deposit by this due date shall be considered a
cancellation of the reservation. The deposit will be returned in full, if inspection reveals
that the facility is left in good condition. If it is not left in good condition, then the

reasonable cost of restoring it to good condition shall be deducted from the deposit and
the balance, if any, will be returned; if the deposit is not sufficient to restore the shelter
or gazebo to good condition, then the group using the facility shall be liable for the
balance and shall be denied further use until the claim is satisfied.
V. CLEAN UP

Each group using the shelter or gazebo is expected to perform a reasonable clean –up
before it leaves. Minimum clean up shall consist of:
a. Removal of all food and beverages from the premises.
b. Picking up and placing all trash and debris in containers provided for this purpose.
c. Cleaning up of any liquids or foods which may have been spilled on floors, tables,
etc.
d. Removal of all decorations, equipment, etc.
e. Sweeping of the floor.
VI. ALCOHOLIC BEVERAGES
No alcoholic beverages are permitted at any time.
VII. NOISE
No excessive or offensive noise that is disturbing to other park users is permitted.
VIII. SHELTER & GAZEBO INSPECTION
The shelter or gazebo will be inspected by City personnel after each use. Please note the
condition when you enter, and if any unusual condition is evident, please note and notify
the City immediately by calling (419) 878-8100, Monday – Friday, 8:00 a.m. to 4:30 p.m.
If after business hours, please call the Waterville Police Department at (419) 878-6666
otherwise, your group will be held responsible.
IX. CONDUCT
The shelters & gazebo are provided for the enjoyment of the City residents and their
guests; however, any conduct which infringes upon the rights of others, is potentially
harmful to the facilities, or is otherwise not in good taste, will not be tolerated. Failure
to abide by these rules of conduct will be ground for causing the shelter to be vacated
and future use denied.
Please realize that these rules and regulations are for the benefit of all users. We respectfully
request your compliance in detail with each item.

Finance and Income Tax Forms 

This is a notice for all landlords who own rental property within the Waterville city limits and for Waterville tenants who rent from a landlord.
**Beginning on January 1, 2013 the Regional Income Tax Agency (R.I.T.A.) will be handling the tax collection and tax administration for the City of Waterville. For more information regarding Waterville income tax regulation, visit Waterville’s website
www.waterville.org for a copy of the Ordinance, or R.I.T.A.’s website www.ritaohio.com for
frequently asked questions.
LANDLORDS:
As stated in the City of Waterville Ordinance, landlords of rental property located within
the city limits have three responsibilities.
♦ First – you are required to report net profits from rental property located within
the city. This can be done by filing a return that includes your federal Schedule E
or other appropriate schedule.
♦ Second – Effective January 1, 2012, Landlords are required to provide the Tax
Commissioner a report showing the names, addresses (including suite letters/
numbers if applicable), telephone numbers and, if known, the place of employment
for each resident or business that occupies each rental property
♦ Landlords are also required to provide the Tax Department with a list of any move
-ins or move-outs within 30 days of said move.
TENANTS:
As stated in the City of Waterville Ordinance, any person who rents property located
within the city limits, is required to pay income tax to the City and to file an annual income tax return. The Waterville income tax rate is 2%. However, if you work within another taxing municipality, we do allow a credit of not more than 1.5% for tax paid to another municipality.
